Privacy Policy
In short: Cartive uses the information you provide to respond to your enquiry and assess how we may be able to help. We do not sell personal information or use enquiry details for marketing unless we ask separately and you actively opt in.
1. Who we are
Cartive is a UK fleet consultancy operated by Helen Tivey as a sole trader. For UK data protection law, Helen Tivey trading as Cartive is the controller of the personal information described in this policy. This means we decide why and how that information is used.
Website: cartive.co.uk
Privacy enquiries and rights requests: info@cartive.co.uk
2. Scope of this policy
This policy applies when you visit cartive.co.uk, submit its contact or enquiry form, or correspond with Cartive about that enquiry. It does not cover a third-party website reached through a link from our site, and that third party's own privacy information will apply.
3. Information we collect
Depending on how you use the website and which form fields you complete, we may collect:
-
Identity and contact details, such as your name, work email address and telephone number;
-
Business details, such as your organisation, job role and relationship to the organisation;
-
Enquiry details, such as fleet size, your main fleet challenge, the services you are interested in and anything you include in your message;
-
Correspondence and follow-up records, including emails, call notes and actions agreed;
-
Technical and usage information generated when you use the site, such as IP address, browser or device information, timestamps, security logs, pages viewed and cookie preferences, where available through Wix or permitted cookies.
Please do not use the enquiry form to send special category information (for example, health, ethnicity, religion, political opinions, trade union membership, genetic or biometric information, or information about sex life or sexual orientation), criminal-offence information, payment-card details, driving-licence information or employee fleet records. If detailed fleet data is needed later, Cartive will agree an appropriate and secure way to provide it.
4. How we obtain information
Most personal information is provided directly by you when you complete the website form, email or telephone us, or continue an enquiry. Technical information may be collected automatically by Wix and related website technologies. We may also receive business contact information from a colleague who asks us to contact you; if so, we will provide this privacy information by our first contact or within one month, whichever is earlier, unless an exemption applies.
5. How and why we use information
Responding to and managing enquiries
We use your details to read and respond to your enquiry, arrange a discussion, understand your organisation's requirements, decide whether Cartive's services may be suitable and keep an appropriate record of the conversation.
Our lawful basis is taking steps at your request before entering into a contract where you enquire in a personal capacity. For enquiries made on behalf of an organisation, and for proportionate follow-up and business administration, our lawful basis is legitimate interests: operating Cartive, responding to prospective clients, maintaining accurate records and developing business relationships. We consider this use reasonably expected and limited in impact because you or your organisation initiated or invited the contact.
Operating and protecting the website
We may use technical information to deliver the site, prevent fraud or misuse, maintain security, diagnose faults and understand whether the site is working. Our lawful basis under UK GDPR is legitimate interests in operating a secure and effective website. Strictly necessary cookies and similar storage may be used without consent where the law permits because the site cannot function properly without them.
Optional analytics or other non-essential cookies
If analytics, functional or marketing technologies are enabled, they will be used only in line with the choices offered through our cookie banner. Where consent is required, our lawful basis under UK GDPR is consent, and the relevant technology will not be activated before that consent is given. You can refuse or withdraw consent at any time through the site's cookie settings. Withdrawing consent does not affect processing that was lawful before withdrawal.
Legal, regulatory and dispute purposes
We may use relevant information to comply with law, respond to lawful requests, obtain professional advice, establish or defend legal claims and protect our rights or those of others. Our lawful basis is legal obligation where a law requires the processing, and otherwise legitimate interests in protecting and enforcing legal rights.
6. When you must provide information
You are not legally or contractually required to submit the website enquiry form. However, we need at least your name, a working contact method and enough information about the enquiry to respond. If required information is not provided, we may be unable to deal with the enquiry.
7. Who we share information with
We disclose personal information only where reasonably necessary. Recipients may include:
-
Wix.com Ltd and its group companies and sub-processors, which provide the website, hosting, form, security and related platform services;
-
Our email, IT, cloud-storage and communications providers, once selected, where they process information for us;
-
Professional advisers such as accountants, insurers, legal advisers or consultants where their involvement is necessary;
-
Courts, regulators, law-enforcement bodies, tax authorities or other public bodies where disclosure is required or permitted by law;
-
A purchaser, successor or adviser involved in a genuine proposed sale, transfer or restructuring of Cartive, subject to appropriate confidentiality and data-protection safeguards.
We require service providers acting on our behalf to protect personal information and use it only for the services they provide. We do not sell or rent personal information.
8. International transfers
Wix is a global provider. Wix states that site-visitor information may be processed in the United Kingdom, European Economic Area, Israel, the United States and other locations used by Wix and its sub-processors. Some of these locations are outside the UK.
Where UK personal information is transferred outside the UK, we rely on the safeguards made available by the relevant provider and required by UK data protection law. Depending on the destination, these may include UK adequacy regulations or appropriate contractual safeguards, such as the UK International Data Transfer Agreement or UK Addendum to approved standard contractual clauses, together with supplementary measures where required. Information about Wix's arrangements and current sub-processors is available through Wix's privacy and data-processing documentation. You may contact us to request further information about safeguards relevant to your personal information.
9. How long we keep information
We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, including legal, accounting, security and dispute requirements.
-
An enquiry that does not become a client relationship will normally be deleted or anonymised 12 months after the last meaningful contact.
-
If an enquiry becomes a client relationship, relevant correspondence and contract records will normally be retained for up to six years after the relationship ends, or longer where tax, regulatory, insurance or legal requirements apply.
-
Cookie consent records and technical or security logs are retained for the period needed to demonstrate consent, maintain security and operate the service, taking account of the settings and retention periods applied by Wix and any approved integration.
We may keep information longer where a complaint, dispute, investigation or legal claim is anticipated or ongoing. When information is no longer required, we will delete it securely or anonymise it so that it can no longer identify an individual.
10. Cookies and similar technologies
Wix places certain cookies that support security, fraud prevention, stability and core site functions. The website may also use other cookies or similar technologies if features, third-party apps or integrations are added.
Our cookie banner is intended to let you accept or decline non-essential categories and revisit your choices. Strictly necessary cookies remain active because they are required for the site to operate. Current details of the cookies detected on the site, their purposes and durations should be available through the cookie banner or cookie settings panel. Browser controls can also block or delete cookies, although doing so may affect site functionality.
11. Security
We use reasonable technical and organisational measures designed to protect personal information against accidental or unlawful loss, misuse, alteration, unauthorised access or disclosure. These include limiting access to people and providers that need it, using password-protected accounts and the security controls available through our service providers. No internet service can be guaranteed completely secure, so please do not send sensitive fleet or employee data through the general enquiry form.
12. Your data-protection rights
Depending on the circumstances and the lawful basis used, you may have the right to:
-
Be informed about how your personal information is used;
-
Ask for access to your personal information and receive a copy;
-
Ask us to correct inaccurate or incomplete information;
-
Ask us to erase information in certain circumstances;
-
Ask us to restrict processing in certain circumstances;
-
Object to processing based on legitimate interests;
-
Receive information you provided in a portable format where the legal conditions apply; and
-
Withdraw consent at any time where we rely on consent.
RIGHT TO OBJECT: You have the right to object to processing based on our legitimate interests. We will stop unless we can demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing is needed for legal claims. If personal information is ever used for direct marketing, you can object at any time and we will stop using it for that purpose.
To exercise a right, email info@cartive.co.uk. We may need to ask for information to confirm your identity and understand the request. There is normally no fee, and we will respond within the period required by law. Some rights are qualified and may not apply in every situation.
13. Complaints
Please contact us first if you have a concern so that we can try to resolve it. You also have the right to complain to the UK Information Commissioner's Office (ICO):
Telephone: 0303 123 1113
Post: Information Commissioner's Office, Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF
14. Children
Cartive provides business-to-business consultancy services and the website is not intended for children. We do not knowingly seek or collect personal information from anyone under 18 through the enquiry form. If you believe a child has provided information, please contact us so that we can take appropriate action.
15. Automated decision-making
We do not use website enquiry information to make decisions based solely on automated processing that produce legal or similarly significant effects on an individual.
16. Changes to this policy
We will review this policy when the website, service providers or uses of personal information change. We will publish the updated version on this page and change the 'last updated' date. If a change materially affects how we use information already collected, we will take reasonable steps to bring it to the attention of affected individuals before the new use begins.
